Frequently asked questions: divorce and family law

What types of divorce exist in Tunisia?

Article 31 of the Personal Status Code provides for three: divorce by mutual consent, divorce for harm at the request of one spouse, and divorce at the sole wish of the husband or the wife. Each has different consequences for compensation and maintenance.

Are there reconciliation hearings before the judgment?

Yes. The family judge tries to reconcile the spouses before ruling, and there are more reconciliation hearings when the couple has minor children. A lawyer helps you prepare for them and set out interim requests such as maintenance and custody.

When do I need a lawyer for a divorce?

When there is a disagreement about maintenance, custody, housing or compensation, or when the other spouse files for divorce for harm. The lawyer assesses the documents you need, drafts the claims and represents you in court.

General guidance only: it does not replace advice from a lawyer on your situation.
