Inheritance lawyers in Ben Arous: list and phone numbers

After a death, the estate starts with a certificate (hojjet el wafet) that records the death and names the heirs and their shares; the division comes next. When the heirs disagree, especially about a property, a lawyer helps reach an amicable division or brings a partition case before the court.

Frequently asked questions: inheritance law

What is the heirship certificate and who issues it?

This certificate (hojjet el wafet) records the death and lists the heirs. It is drawn up by a notary (adl ichhad) and is the first document required for any step on the estate: the bank, the Land Registry or the division.

One heir refuses to divide the estate: what can we do?

Nobody can be forced to remain in co-ownership. If no agreement is reached, any heir can ask the court for partition: the court divides the property in kind where possible, or authorises its sale and shares the proceeds according to each share.

General guidance only: it does not replace advice from a lawyer on your situation.
