Real estate lawyers in Tunisia: list and phone numbers

Property disputes are among the most common cases in Tunisia: proving ownership, dividing property held in co-ownership by heirs, pre-emption, rentals, or a sale that was never completed. A real estate lawyer checks the status of the property and its title deeds before taking any step.

Frequently asked questions: real estate law

What is the difference between registered and unregistered property?

Registered property has a land title at the Land Registry (Conservation de la propriété foncière) showing its owner and the rights attached to it, which makes it stronger evidence. Ownership of unregistered property is proven with deeds and documents, and its disputes usually take longer. That is why a lawyer starts by checking the status of the property.

We inherited a property in co-ownership: how do we divide it?

If the co-owners agree, the partition is done amicably by deed. If not, any co-owner can ask the court for partition; the court may divide the property in kind where possible, or order its sale and share the proceeds. If one co-owner sells their share to an outsider, the others may have a pre-emption right.

Can a tenant who does not pay rent be evicted?

Yes, but through legal proceedings and never by force: it usually starts with a formal notice served by a bailiff, then a case before the competent court. A lawyer chooses the right procedure depending on the type of lease and its terms.

General guidance only: it does not replace advice from a lawyer on your situation.
